My sisters boyfriend Aziz, is from afghanistan... they have been together over 2 years, they dont live together but he stays with her often and all the family know him. He has just recently been refused a FLR (O) visa based on his relationship with my siater and human rights (i.e. it is dangerous to return to Afghanistan) we need advice on what they can do?
Aziz was seeking asylum in june 2009 and the UK gave him 1 year dicretionary leave to stay, then in 2011 his asylum claim qas refused. He then had met a girl (nor my sister) abd they were goinf to marry in 2011 abd reapply based on that. However the government came and detained him on the wedding day and ge could not marry. They kept him detained for 1 month but in 2013 grabted gim a visa for 2.5 years.
Due to stresses of the situation and othwr factors he split with the girl in October 2013.
His visa based on this relationship expired in January 2016. By which time he had been now seeing my sister for 2 years so they applied for the FLR (O) visa based on their relationship and human rights, but he had just been refused... can you advise on what to do now... will marriage help prove their relationship or will that make things worst etc.?

as far as i know he cant use this form if he wants to get a visa for being partner of her. I believe visa type was wrong.

The form he used to apply is nothing about family life.... Altough i believe it will be so difficult for him to be succeed after all his troubles with his private applications and gf etc.
It might be slightly different (in positive way) if your sister get married first and then apply.
You really really have to submit a number of documents and pictures to prove that your relationship is geniune.
Also i would advice your sister to work with a strong advicer to prepare her application. By the way they must prove that she lives with him for more than 2 years with utility bills , support letters written by their friends etc. If she cant or she doesnt live with him for 2 years then i would advice your sister to get married and then apply. Because he cant apply as unmarried parter of your sister if their relationship is less than 2 years.
